Purpose These Terms & Conditions (T&C) govern the access and use of the Easy Data Analysis Tools service, provided by Thomas LEQUEUX Consulting, a French micro-enterprise headquartered at 5 Allée de l’Autan, 31850 Montrabé, France, registered under SIRET 940 719 180 00017 (“the Provider”). This service allows users to analyze Excel data from Kobo/ODK databases through an Excel add-in integrating automation and AI-assisted interpretation features. ________________________________________ 2. Nature of the Service The service offered is an automated analysis and interpretation service, accessible via an Excel add-in provided to the user upon registration. The add-in is not a standalone software but a technical interface to access a service operated by the Provider, including: • Local generation of analytical tables in Excel • AI interpretation via OpenAI’s API • Access to a personal account managed through a user ID ________________________________________ 3. Access Conditions The user can access the service by: • Creating an account with a valid email address and password • Choosing a plan (free or paid) • Accepting these T&C and the Privacy Policy The Provider reserves the right to refuse or suspend access in case of abuse, fraud, or violation of these T&C. ________________________________________ 4. Pricing and Payment Current pricing is displayed on the Provider’s official website: https://lequeux-thomas.com/addin/ Payment is processed via Stripe. Users can choose: • A free plan with limited usage • A monthly or annual subscription (auto-renewed unless canceled) ________________________________________ 5. Right of Withdrawal In accordance with Article L221-28 of the French Consumer Code, no right of withdrawal applies once service execution has begun (software access and/or first API call). By registering and accessing the service, the user expressly agrees that execution begins immediately and waives their right of withdrawal. ________________________________________ 6. Responsibilities The Provider undertakes to use reasonable means to ensure service availability and reliability of analyses. However: • The service is provided “as is” and cannot guarantee perfect or error-free interpretation. • The user remains solely responsible for the use of generated results, particularly in professional or institutional contexts. The Provider shall not be liable for indirect damages, data loss, or decisions made based on generated analyses. 6 bis. Third-Party Providers The Provider relies on third-party services necessary for the proper functioning of the Service: • Supabase: account management and secure user data storage. • Stripe: payment processing and subscription management. • Render: backend hosting. • OpenAI: AI analysis execution on user request. • Hostinger: website hosting. These providers act as subprocessors under GDPR. Details of their roles and guarantees are provided in the Privacy Policy. ________________________________________ 7. Personal Data Personal data collected (email, ID, service usage) is processed in accordance with the Privacy Policy. Users retain at all times their GDPR rights of access, rectification, and deletion. Full details of processing and subprocessors are available in the Privacy Policy on the Provider’s website. ________________________________________ 8. Termination Monthly Plan: • The user may terminate their subscription at any time by sending a request by email to thomas.lequeux.consulting@gmail.com or via: https://lequeux-thomas.com/contact-us. • The user may choose whether or not to enable automatic renewal. In the event of termination, the subscription remains active until the end of the current paid monthly period, after which it automatically expires. • In case of non-payment, access to the service is immediately suspended, without any grace period. Annual Plan: • The user may also terminate their subscription at any time. The subscription remains active until the end of the current paid annual period, after which it automatically expires. • No refund (partial or full) is granted in case of early termination. ________________________________________ 9. Intellectual Property All content, code, and technologies related to the Easy Data Analysis Tools add-in remain the exclusive property of Thomas LEQUEUX Consulting. Any reproduction, distribution, or misuse is strictly prohibited without written authorization. ________________________________________ 10. Governing Law These T&C are governed by French law. In case of dispute, an amicable resolution will be sought before any legal action. Competent court: Toulouse (or other jurisdiction applicable to consumer users). ________________________________________ 11. Ethical, Humanitarian, and Compliance Commitments Thomas LEQUEUX Consulting operates in compliance with internationally recognized ethical and humanitarian standards. In line with its Ethical Charter, as a data analysis service provider in the humanitarian sector, it adheres to the following principles: 11.1 Humanitarian principles and rights • Respect for humanity, neutrality, impartiality, and independence • Commitment to dignity, diversity, and equal access to assistance • Rejection of any discrimination, exclusion, or stigmatization in service use 11.2 Protection from exploitation, abuse, and violence (PSEA) • Zero tolerance for any form of exploitation, abuse, or sexual harassment • Refusal to collaborate with any entity or user involved directly or indirectly in such behavior • Commitment to respond appropriately to any legitimate ethical report 11.3 Counter-terrorism and international compliance • Compliance with international regulations against terrorism financing • Refusal to provide services to persons, entities, or states subject to sanctions, watchlists, or investigations related to terrorism or serious violations of international humanitarian law • Users must not use the service for activities that directly or indirectly promote or support unlawful or violent actions 11.4 Ethical use of technology and data • The tool relies partly on AI technologies; usage is governed by principles of transparency, anonymization, and user sovereignty • Users agree to transmit only data they are authorized to use and to avoid sensitive or non-anonymized content without a proper legal framework 11.5 Suspension clause In case of reasonable doubt of unethical or illegal service use, or in case of a grave and manifest violation of these T&C, the Provider reserves the right to suspend or terminate user access without notice. Such suspension does not entitle the user to any refund.
